SC Sub-categorisation: Art 341 & Karnataka

  • Art 341: Parliament is the only authority to include/exclude a caste from SC. The state government has no role – it is only a recommendatory body.
  • In the last 20 years, multiple states like Punjab, Bihar, and Tamil Nadu have tried to bring laws for sub-categorising SCs.
  • But the matter is pending in the Supreme Court regarding the constitutional validity of such State laws.
  • 2023: Karnataka Congress party promised to implement Dalit Sub-quotas.
  • 2024: After winning the election, the Karnataka State government (Congress) wrote to the Union Govt to amend Art 341 (3) to facilitate sub-quota.

SC Sub-categorisation: Madiga in Telangana

  • The Madiga community constitutes at least 50% of the total Scheduled Castes in Telangana.
  • Madiga allege that most of the SC reversion benefits have been cornered by the Mala community. So we (Madiga) want sub-quota within SC reservation.

तेलंगाना में मदीगा का समाज के नेताओं का आरोप है कि ज़्यादातर दलित आरक्षण का फ़ायदा उन्हें नहीं मिला बल्कि माला समुदाय के लोगों को मिला है।

SC Sub-categorisation: Union’s Stand

  • 2005: The Attorney General of India had opined that SC categorisation may be done if we have the datasets to prove that it is required.
  • But the National Commissions for Scheduled Castes (SC) opposed, saying that first we need to ensure existing schemes and benefits reach (all) SC on a priority basis.
  • 2023: PM Modi met activists demanding SC-subquota for Madiga caste in Hyderabad (Telangana) and promised look into this matter.
  • 2024: The Union government has formed a five-member committee of Secretaries, chaired by the Cabinet Secretary (IAS), to evaluate how to help the most backward communities amongst the SC.
